B. Martin Luna
Martin Luna is a partner in the firm's Maui office. He concentrates his practice on real estate and administrative law. He has been engaged in the general practice of law for over forty years. Mr. Luna has extensive experience in land use development and permitting on the county and state levels. He was selected by attorney peers for inclusion in The Best Lawyers in America 2010, for Land Use & Zoning Law and Real Estate Law.
Representative Matters
Real Property Development Represents large, as well as small, landowners in obtaining all necessary land use approvals and permits for a range of projects, including condominium and timeshare developments, residential subdivisions, commercial and light industrial facilities, and power plant complexes. Said land use approvals include state land use district boundary amendments, conservation district use permits, community plan amendments, change in zoning, shoreline management area permits, shoreline setback variances, general variances, among others.
Land Use Litigation Represents developers in contested case proceedings for special management area permits and shoreline setback variance before the Maui Planning Commission and special use permits and district boundary amendments before the Land Use Commission of the State of Hawaii. Because of their quasi-judicial nature, contested cases require a knowledge of litigation, administrative law and land use law.
Community Plan Amendment Assists landowners in working with the planning department, the appropriate planning commission and the county council in obtaining the desired land use designation for their properties during the decennial review of land uses by the county. Work involves preparation of project assessment, knowledge of the county zoning codes and state land use classifications, and negotiations with administrative and legislative members of the county government.
Legislation Works with clients in monitoring legislation pending with the Maui County Council and ensuring that appropriate consideration is given to the ramifications of such legislation. Drafted proposed legislation and amendments to proposed legislation pertaining to project district ordinances and various other zoning matters.
Court Annexed Arbitration Program Participates actively as arbitrator in the arbitration program required by the Hawaii Supreme Court for personal injury cases filed in the Circuit Court of the Second Circuit, State of Hawaii.
