Andrew L. Pepper 

Andrew Pepper is a partner in the firm's Honolulu office. He is a commercial litigator. Mr. Pepper's experience has emphasized litigation involving fraud, lender liability, aircraft seizure for creditors, other creditors' rights, and toxic tort disputes.

Representative Matters 

Toxic Tort Represented developer of geothermal well field and power plant in mass toxic tort litigation following catastrophic failure of wellhead. Case involved personal injuries and property devaluations due to chemical contamination. Claimed damages ran into hundreds of millions of dollars; case settled for fraction of demanded amount.

Aircraft Seizure Represented numerous banks and aircraft manufacturers in the seizure and disposition of leased and collateralized aircraft and aircraft engines. Seizures have ranged from multiple widebody jets, turboprops, helicopters, and antique collectable aircraft.

Bankruptcy Represented second largest U.S. bank in regional airline bankruptcy. Client's claims were in excess of thirty million dollars. Through use of aggressive replevin actions strategically targeted against key jumbo jets, client was able to obtain large stock concessions, lease renegotiations, and "most favored nation" status.

Business Sale Litigation Prosecuted counterclaim on behalf of large San Francisco-based radio station conglomerate to obtain specific performance of stock sale contract.

Lender Liability Defended large financial institution against complex lender liability claims involving fraud, breach of contract and breach of confidentiality. Litigated certain aspects of case in U.S. Court of Appeals for the Ninth Circuit.

International Judgment Enforcement Assisted Australian bank in domesticating and enforcing multi-million dollar judgment obtained against Australian citizen who entered the U.S. as a treaty trader.

Corporate Control Battle  Assisted large venture capital firm that had invested in next-generation flash carbonization project in taking control of operating entity and divesting corporate officers and board of directors of control.
